Hm ... I see where this might be open to multiple interpretations.

Clause 21 is in the "unenforceable" section of the Article ... things we strive to provide but cannot enforce under the charter.

When we wrote "you are entitled to Mediation" what we meant was that a list of Mediators would be made available in the Bike Racks Forum. The Article that concerns Mediation, Article 5: Dispute Resolution in the Outside Forum, ¶1 The Bike Racks Forum says that all parties have to agree on a single Mediator.

So I think that if the question arose, the Charter answers it definitively enough - all parties would have to agree to mediate before they would agree on a mediator - but this is probably one of those places where the members might PM one of the loremasters and ask what the rules really are if one person wanted mediation and the other did not.

I had the exact same thought about islands and continents, Jn. :D

Anth, I never ever said that you had to call it the beginning of the road too ... I never mentioned anything about that! That was all you! You're the detail-oriented geek there!



Back on topic, if it says elsewhere in the charter that all members in a dispute must agree to a single mediator to have mediation, then I think that would have to trump any interpretation of this clause meaning a member had a responsibility to agree to mediation. In other words if the question came up the Loremaster would be able to resolve the situation clearly based on other text.

Actually, there was a sign on the other side of the street which had the word "begin" at the top of the sign, and my friends and I commented on the almost poetic implication of such a thing...

Faramond Teh Detail Maniac ( doesn't matter what he said, he is a details guy :D )'s current avatar is cropped from a photo of him standing at the southmost point of the continent of Africa. So there's some neat symmetry in the fact that Anth's ( EDIT: siggie pic before the monster attacks me for being imprecise as well ;) :hug: ) come from far south down the USA continental territory :D

Contextually the interpretation is clear in any case - the Charter nuance is generally to find agreement and against compulsion, particularly in disputes between individuals where we have blatantly stated that others should stay out unless invited.
